Terms of Service

By creating an account or using XM DIGITAL SERVICES LLC you agree to these terms. If you do not agree, please do not use the service.

You must provide accurate information, keep your credentials secure, and be at least 13 years old. You are responsible for activity that happens under your account.

We may suspend or terminate accounts that breach these terms, attempt to circumvent credit limits, or abuse the service.

New accounts receive 20 free credits. Each image costs 5 credits. Credits are reserved when a generation starts and refunded automatically for any image that is not delivered.

Credits have no cash value, are not transferable between accounts, and are not redeemable for money. Purchased credits do not expire while your account remains active.

Free credits are provided per person. Creating multiple accounts to obtain additional free credits is a breach of these terms.

Card checkout is not currently enabled. Paid plans and credit packs are requested through the website by completing a billing form. A request is an offer to buy: it is not a charge, and it does not activate a plan or add credits.

We then issue an invoice to the email address you provide, normally within one business day. Your plan is upgraded and credits are added to your balance only after that invoice has been paid and payment has cleared. Prices are in US dollars and exclude any taxes or duties that apply in your jurisdiction. You are responsible for the accuracy of the billing details you submit; email Info@xmdigitalservices.com before paying if anything needs correcting.

Monthly plans renew each month by invoice until you tell us to stop, and can be cancelled at any time before the next invoice is issued. Annual plans are billed once for a twelve month term at the discounted price shown at the time of your request. Plan credits are granted for each billing period and refresh at the start of the next one; unused plan credits do not roll over. Unpaid invoices simply expire and nothing is owed.

You agree not to use the service to generate content that is illegal, sexually explicit involving minors, hateful, harassing, or that promotes violence or self-harm.

You agree not to generate images of real identifiable individuals in misleading contexts, impersonate others, or infringe intellectual property rights including trademarked characters and logos.

You agree not to attempt to bypass safety systems, reverse engineer the service, resell access, or run automated bulk requests outside normal product use.

You retain rights to the prompts you write. Subject to these terms and to the AI model provider's usage policies, you may use images you generate for personal and commercial purposes.

We do not claim ownership of your generated images. We store them so you can access your gallery and provide the service to you.

AI models can produce similar output for similar prompts, so we cannot guarantee that any image is unique, nor that it is free from third-party claims.

We aim for high availability but the service is provided on an as-is basis. Features may change, and generation depends on third-party model providers whose availability we do not control.

Failed generations are refunded in credits automatically. If you have paid an invoice and are not satisfied, contact us within 7 days of payment; provided you have used no more than 10% of the credits from that purchase we will refund it in full. After that, payments are non-refundable because the service has been delivered, except where required by law or where we have made an error. Duplicate or incorrect payments are always refunded. Our full refund and cancellation policy forms part of these terms and is available at /refund.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of profits, data or goodwill arising from your use of the service. Our total liability is limited to the amount you paid us in the twelve months before the claim.

These terms are governed by the laws of the State of Wyoming, USA, and any dispute is subject to the courts located there. XM DIGITAL SERVICES LLC is registered at 30 N GOULD ST STE N, SHERIDAN, WY 82801.

We may update these terms. Material changes will be posted on this page, and continued use of the service after an update constitutes acceptance.
