Can You Use AI Images Commercially? What to Consider

A plain-language look at ownership, brand safety and the checks worth running before an AI image goes into a paid campaign.

AI images are used every day in ads, blog posts, packaging mockups and product pages. Using them responsibly is mostly about a few habits rather than deep legal expertise.

Know what your account grants you

With XM Digital Services LLC, images you generate are yours to use for personal and commercial projects, subject to our Terms of Service and the underlying model provider's usage policies. Read both once — they are shorter than you expect.

Avoid other people's identity and intellectual property

  • Do not prompt for named real people, especially in endorsement-style scenes.
  • Do not ask for trademarked characters, logos or packaging.
  • Do not imitate a living artist's signature style by name for commercial work.
  • Treat likenesses of anyone recognisable as requiring permission.

Check before you publish

  • Hands, text and reflections — the three places AI artefacts hide.
  • Cultural and demographic representation in people-heavy scenes.
  • Claims implied by the image: a product photo should not show features the product lacks.
  • Regulated categories such as health, finance and children's products deserve extra scrutiny.

Disclose when it matters

Some platforms and jurisdictions require labelling synthetic media. When in doubt, a short caption noting the image is AI-generated costs you nothing and builds trust with your audience.
